JUNE 2018 – The U.S. Court of Appeals for the Ninth Circuit affirmed a $14.9 million judgment for Kendall Brill & Kelly client, Viacom International, Inc. The suit was brought after toymaker MGA failed to pay $3.5 million due for unpaid advertising bills and under a 2012 co-finance agreement with Viacom to broadcast a TV series based on the toymakers’ line of Lalaloopsy dolls.
The judge in the lower court granted Viacom’s motion for summary judgment and awarded it more than $14.9 million in September 2016. In a unanimous opinion on June 21, 2018, the appellate court rejected MGA’s claims and upheld the lower court’s decision. Richard B.
