February 2020 – Kendall Brill & Kelly LLP Attorney Sarah E. Moses, representing a transgender woman inmate on a pro bono basis, argued and won her first Ninth Circuit appeal in a case involving allegations that an Arizona correctional officer sexually harassed and assaulted the inmate. KBK had successfully opposed the individual officer’s motion to dismiss the complaint on absolute immunity and qualified immunity grounds in the lower court. The officer appealed, and the Ninth Circuit Court of Appeals, following Ms. Moses’ argument, upheld the lower court’s decision to deny the immunity claims. KBK Partners Nicholas F. Daum, Bert H. Deixler and Patrick J. Somers also participated in the briefing for the appeal.
